Liability Waiver & Terms of Use
Assumption of Risk
Members and visitors acknowledge that participation in physical activities and the use of gym equipment involve inherent risks, including but not limited to the risk of injury, illness, or death. All individuals voluntarily assume full responsibility for any risks associated with their participation.
The gym environment may include potential hazards such as wet floors, heavy equipment, and the actions of other members, which could result in injury.
Medical Clearance
Members confirm that they are in good health and do not have any medical conditions that would prevent safe participation in gym activities. Individuals are encouraged to consult with a physician prior to commencing any exercise program, particularly if there are concerns regarding health or fitness.
Members agree to notify Knights Sports Gym of any changes to their health status that may affect their ability to safely participate in physical activities.
Release of Liability
Knights Sports Gym, including its owners, employees, contractors, and agents, shall not be held liable for any claims, liabilities, losses, or damages arising from participation in gym activities, including but not limited to personal injury, property damage, or wrongful death.
This release applies to all claims, including those arising from the negligence of Knights Sports Gym or its staff, to the fullest extent permitted by law.
Indemnification
Members agree to indemnify and hold harmless Knights Sports Gym, its owners, employees, and agents from any claims, liabilities, damages, or expenses arising from their actions or omissions while using the gym facilities. This includes any legal fees or costs incurred in defending such claims.
Rules and Regulations
All members and visitors are required to comply with the gym’s rules and regulations, including proper use of equipment, hygiene standards, and respectful conduct toward staff and other members.
Failure to comply with these rules may result in suspension or termination of membership without refund.
Photography and Video Release
Knights Sports Gym reserves the right to use photographs and video footage taken within the facility for promotional and marketing purposes without compensation.
Individuals may withdraw consent by providing written notice to Knights Sports Gym.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
Severability
If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
